1. Acceptance of Terms
These Terms of Service ("Terms") are a binding legal agreement between you and WonderCast ("WonderCast," "we," "us," "our"). They govern your access to and use of the WonderCast website, web application, and iOS/Android mobile applications, and all related features, content, and services (the "Service").
By creating an account, clicking "I agree" (or a similar control), or otherwise accessing or using the Service, you confirm you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, incorporated by reference. If you do not agree, do not use the Service.
If you accept on behalf of a household or family, you do so as the adult account holder and represent you have authority to bind other members.
We may update these Terms. We use a version-gated acceptance model: each version carries an identifier and we record the version you accepted. On material changes we will ask you to review and accept the updated Terms before continuing (see section 18).
2. Eligibility & Accounts
- 2.1 You must be an adult. You must be at least 18 (or the age of majority where you live, if higher). The Service is for and operated by adults only.
- 2.2 The account holder is the parent or legal guardian of any child whose name, age, gender, photo, voice, or other details are added. By using the Service for a child you represent and warrant you hold that role and may provide that child's information and consent on the child's behalf.
- 2.3 No child accounts. Children do not have accounts, do not sign in, and do not create content. Children appear only as parent-managed "Characters" and may only view content you create. See section 4 and our Children's Privacy notice.
- 2.4 One adult per account. You are responsible for all activity under your account.
- 2.5 Accurate information. Provide accurate, current, complete registration info and keep it updated.
- 2.6 Account security. Safeguard your credentials; notify us promptly of unauthorized use at support@wondercast.app. We are not liable for losses from your failure to secure credentials.
3. Description of the Service
WonderCast is an AI-powered platform that lets adults create personalized children's storybooks, videos, and audiobooks, on web and iOS/Android. Stories, images, narration, and other media are generated using AI, including third-party AI providers (see section 8). The Service offers a describe-only path (no photos or voice) and optional biometric features (likeness and custom voice) requiring separate consent (see section 9). We may add, modify, suspend, or discontinue features, using reasonable efforts to notice material changes adversely affecting paid features.
4. Parental Responsibility & Children
- 4.1 You control everything — all Characters, inputs, and generated content. Children only view what you choose to show.
- 4.2 Supervise viewing. AI content may be inaccurate or unexpected — always review generated content before showing a child (see sections 7 and 13).
- 4.3 Children's privacy. Information about a child is collected only from you, the parent or guardian — never directly from the child. See our Children's Privacy notice.
- 4.4 Biometric features require separate consent. Adding a child's photo (a "faceprint") or voice (a "voiceprint") is optional and requires separate, affirmative consent beyond these Terms. In the US, before any child biometric data is collected, you must also complete Verifiable Parental Consent (VPC). See section 9 and our Biometric Retention & Destruction Schedule.
5. Acceptable Use & Prohibited Conduct
You agree to use the Service only lawfully and not to:
- generate, upload, or share content that is hateful, harassing, threatening, or violent;
- generate, upload, or share sexually explicit material, or any content that sexualizes, exploits, or endangers minors;
- generate or share content infringing the IP, privacy, publicity, or other rights of any person;
- upload another person's photo, voice, or biometric data (including a child's) without authority (i.e., unless you are their parent or legal guardian or have their lawful, informed consent);
- impersonate anyone or misrepresent your relationship to a child;
- use the Service to build a competing product, or to train, fine-tune, or benchmark any ML model;
- reverse engineer, decompile, or derive source or models (except where this restriction is legally prohibited);
- scrape, crawl, or bulk-extract content by automated means;
- circumvent or exceed usage limits, rate limits, or access controls.
We may suspend or terminate accounts that violate these rules (see section 16).
6. User Content & Inputs
- 6.1 Your inputs. "User Content" means what you provide — character names and descriptions, prompts, and any photos or voice recordings you upload. As between you and us, you retain ownership of your User Content.
- 6.2 License to operate the Service. You grant WonderCast a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, reproduce, and create derivatives of your User Content solely to provide, secure, and support the Service for you (including sending it to the AI processors in section 8 to generate your stories). This license ends when the content is deleted, except for backups retained briefly and as required by law.
- 6.3 Your responsibility & warranty. You are solely responsible for your User Content and represent and warrant that you have all rights and authority to provide it, and that doing so does not violate any law or any third party's rights. For any photo, voice, or biometric data of another person (especially a child), you confirm you are their parent or legal guardian or have their lawful, informed consent.
- 6.4 We don't train on it. We do not use your User Content to train AI models, and our AI providers process it on no-training terms (see section 8). We may use de-identified, aggregated data to operate and improve the Service.
7. AI-Generated Content
- 7.1 Outputs. Subject to these Terms and the providers' terms, the stories, images, audio, and video the Service generates for you ("Output") are yours to use for personal, family, and non-commercial purposes.
- 7.2 "As is" / review first. AI Output may be inaccurate, incomplete, or unexpected and is provided without warranty (see section 13). Always review Output before showing it to a child. Do not rely on Output as professional, medical, legal, or safety advice.
- 7.3 Similar outputs. AI may produce similar Output for different users; we do not guarantee uniqueness.
8. Third-Party Services
To provide the Service we use trusted third-party processors: ElevenLabs (voice), Google / Vertex AI (images and likeness), AWS (storage and processing), and Stripe (payments). Your use may be subject to their terms. These AI providers operate on terms under which your data is not used to train their models, and source photos are deleted after use. How data flows to these providers is described in our Privacy Policy. We are not responsible for third-party services outside our control.
9. Biometric & Media Features
- 9.1 Optional. Likeness (photo to faceprint) and custom voice (voice to voiceprint) features are optional; the describe-only path always works without them.
- 9.2 Separate consent + VPC. Before collecting a child's biometric data you must give separate, affirmative consent, and in the US complete Verifiable Parental Consent. You may add a child's biometric data only if you are their parent or legal guardian.
- 9.3 Retention & deletion. Biometric data is retained and destroyed per our Biometric Retention & Destruction Schedule. You can withdraw consent and delete this data any time in Settings → Privacy & Permissions; withdrawal also deletes the voiceprint at our voice provider.
10. Subscriptions, Billing & Refunds
- 10.1 Plans & billing. Some features require a paid subscription, billed through Stripe on a recurring basis (monthly or annual) at the price shown at purchase, plus applicable taxes.
- 10.2 Auto-renewal. Subscriptions automatically renew until canceled. You can cancel any time in your account settings; cancellation takes effect at the end of the current billing period.
- 10.3 App-store purchases. If you subscribe through the Apple App Store or Google Play, billing, renewals, and cancellations are handled by that store under its terms, and you manage or cancel the subscription there.
- 10.4 Price changes. We may change prices with reasonable advance notice to existing subscribers; changes apply to the next renewal.
- 10.5 Refunds. Refunds are handled per our refund policy and applicable law (currently: case-by-case within 14 days of purchase), and, for app-store purchases, by the relevant store.
11. Intellectual Property
The Service, including its software, AI models, designs, text, and the WonderCast name and logos, is owned by WonderCast or its licensors and is protected by IP laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service per these Terms; no other rights are granted. If you give us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
12. Privacy
Your use of the Service is subject to our Privacy Policy and Children's Privacy notice, which explain what we collect, how we use it, and the third parties that process it. By using the Service you consent to those practices.
13. Disclaimers ("AS IS")
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free, or that AI Output will be accurate or appropriate. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WONDERCAST AND ITS PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED the greater of the total amount you have paid WonderCast in the 12 months before the claim, or US$100. Some jurisdictions do not allow these limits, so some may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless WonderCast and its officers, employees, and providers from any claims, damages, and costs (including reasonable legal fees) arising from: (a) your User Content; (b) your breach of these Terms or violation of law or any third party's rights; or (c) your upload of another person's photo, voice, or biometric data without authority.
16. Termination & Suspension
- 16.1 By you. You may stop using the Service and delete your account any time in your account settings.
- 16.2 By us. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or as required by law, with notice where practicable.
- 16.3 Effect. On termination your right to use the Service ends. Account and content deletion, including biometric data destruction, is handled per the Privacy Policy and the Biometric Retention & Destruction Schedule. Sections that by their nature should survive (e.g., sections 6.3, 7, 11, 13 through 15, 17, and 19) survive termination.
17. Dispute Resolution & Governing Law
If you have a concern or dispute, please contact us first at support@wondercast.app so we can try to resolve it informally. If we cannot resolve it that way, any dispute relating to these Terms or the Service may be brought before the courts of competent jurisdiction. These Terms are governed by applicable law.
18. Changes to the Terms
We may modify these Terms. When we do, we update the Version and "Last updated" date. For material changes we will require you to review and accept the updated Terms before continuing (the version-gated model in section 1). Your continued use after the update, following any required acceptance, constitutes agreement. If you do not accept, you must stop using the Service.
19. Miscellaneous
Entire agreement — these Terms plus the Privacy Policy are the entire agreement between you and us regarding the Service. Severability — if a provision is unenforceable, the rest remains in effect. No waiver — our failure to enforce a right is not a waiver. Assignment — you may not assign these Terms; we may assign them, including in connection with a merger, acquisition, financing, or sale of assets (change of control). Force majeure — we are not liable for delays or failures beyond our reasonable control. Notices — we may notify you in-app or by email. Export/sanctions — you represent you are not barred from using the Service under applicable trade laws.
